Martek Biosciences plans appeal of E.U. ruling on infant formula patent - St. Louis Business Journal:

The patent office in the Netherlands upheld a patent that was granted to the biotecbh firm in 2007 but was challenged by food manufacturerssand Ltd. The patent office said Martek’s patent appliea to Martek’s nutritional oil in infant formula, but is not coveredc when it is blended with certain fish oils used ininfant formula. Martek (NASDAQ: expects the appeal will take one to two yeara and said it does not believe the ruling will impactits revenue.

Martekl warned in its last earnings statement that its infantt formula sales in the third and fourth quarter could drop as retailers trim their inventoriese ofthe product. The company anticipates demand will pick up infiscapl 2010.
